A property may be exempt if no-one lives in it because the person who usually pays council tax is in prison or detained in a hospital.
Before you start
Apply if the person who pays council tax has been detained or imprisoned due to:
- An order of a court
- Being in custody under military law
- Being remanded in custody
- Being detained under a Mental Health Act.
They will not get the exemption if they are in prison for not paying council tax or a fine.
You will need
- A copy of the order, if the person has been detained under the Mental Health Act
- Letter confirming detention or document showing prison number, if in prison

What happens next
We will write to confirm detention and send a new bill showing any changes.
